Digital Heights Inc. provides website development, digital marketing tools, training materials, and support services to help individuals start and operate their own digital service businesses. Our services include:

• Custom website creation and setup
• Pre-loaded service offerings and templates
• Access to digital tools and platforms
• Training materials and educational content
• Ongoing support based on your selected package

• All prices are listed in US Dollars (USD)
• Payment is due in full at the time of purchase unless otherwise agreed
• We accept major credit cards and other payment methods as displayed at checkout
• You are responsible for any applicable taxes
• Subscription services, if applicable, will automatically renew unless cancelled before the renewal date

Due to the digital nature of our services and the immediate commencement of work upon purchase:

• Refund requests must be made within 14 days of purchase and before substantial work has begun
• Once website development has started or access to digital tools has been provided, refunds may be prorated based on work completed
• Training materials and digital downloads are non-refundable once accessed

You agree NOT to use our services to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Transmit harmful, offensive, or illegal content
• Engage in fraudulent, deceptive, or misleading practices

• Interfere with the security or operation of our services
• Resell or redistribute our services without authorization

We reserve the right to suspend or terminate your access for violation of these terms.

• All content, materials, and intellectual property provided by Digital Heights remain our property or the property of our licensors
• Upon full payment, you receive a license to use the website and materials created for your business
• You retain ownership of any original content you provide to us (logos, text, images)
• You may not copy, modify, distribute, or create derivative works from our proprietary training materials without permission

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties that services will be uninterrupted or error-free
• Warranties regarding the accuracy or reliability of any information

IMPORTANT: We make no guarantees regarding income or financial results.

• Any income examples or testimonials are not guarantees of your potential earnings
• Your results will depend on your effort, skills, and market conditions
• We provide tools and training, but success requires your active participation and work
• Past performance or results of other customers do not guarantee similar outcomes for you

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL HEIGHTS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES.

You agree to indemnify, defend, and hold harmless Digital Heights Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of our services, your violation of these Terms, or your violation of any rights of a third party.

• These Terms shall be governed by the laws of the State of Washington, without regard to conflict of law principles
• Any disputes arising from these Terms or our services shall be resolved through binding arbitration in Seattle, Washington
• You waive any right to participate in a class action lawsuit or class-wide arbitration

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after any changes constitutes acceptance of the modified Terms.
